PAYMENT TERMS
Invoices are issued within 48h upon delivery of the finished Project.
The balance of an invoice is due within 14 days of its issue unless otherwise specified.
For projects taking longer than 30 days, interim invoices may be issued on a monthly basis, to the amount of work executed during that period.
Except for the portions of invoices that are disputed in good faith by the Client for not being in accordance with the terms and conditions of this Agreement, any amounts not paid when due shall accrue interest at the rate of 5% per month from the date due until paid.

FEES FOR SERVICE
Projects will be invoiced to reflect the total of actual hours (including: consulting, storyboarding, design, research, copywriting, editing), and based on a standard hourly rate of
• AUD $250.00 per hour + GST for corporate / for-profit businesses
• AUD $220 per hour + GST  education, research and/or Not-For-Profit organisations

CHANGES TO THE SCOPE OF WORK
Revisions or author’s alterations to the scope of work shall obligate the Client to additional fees.
These may include but are not limited to: changes made to copy after the final deliverables have been submitted; changes made to the design once format and layout have been approved; extensive alterations; a change in project’s objectives on the part of the Client and new work requested by the Client after the execution of the Agreement.
All production costs are based on the assumption that copy will be provided electronically.
Change orders will be prepared by Crealo Pty Ltd and provided to the Client outlining the changes to the Scope of Work, and any additional costs for those changes.
The Client agrees to pay Crealo Pty Ltd additional fees and costs for said revisions or alterations at a rate of
• AUD $250.00 per hour + GST for corporate / for-profit businesses
• AUD $220 per hour + GST  education, research and/or Not-For-Profit organisations
Hourly rates quoted in proposals remain in effect until further written notice is given.
If Crealo Pty Ltd is unable to meet the delivery schedule due to delays by Client or changes requested by Client in the Scope of Work, Crealo Pty Ltd may, in its discretion, revise the production schedule as necessary and provide for adjustments in the costs for the Project.

REVISIONS
Unless otherwise specified, feedback and change requests from the Client expected within 5 business days of supplying a preview.
Content changes must be supplied in writing from the Client.
Crealo Pty Ltd reserves the right to make minor edit client content for typesetting purposes.

APPROVAL OF FINAL ARTWORK
While Crealo Pty Ltd takes all care to avoid errors, Crealo Pty Ltd accepts no responsibility for typographical errors, spelling mistakes, or incorrect information. The Client is to proof read and approve all final copy before the diffusion of artwork. The email verification of the Client’s Representative shall be conclusive as to the approval of all artwork prior to their release for printing or online diffusion. No refunds or reprints are given after a final approved design due oversights by the Client’s proof reading.

COPYRIGHT AND INTELLECTUAL PROPERTY
The ownership of copyright in all Works being produced remains with Crealo Pty Ltd for the duration of the project.
Crealo Ltd also retains copyright of draft concepts, working notes and any other internal written materials; preliminary drafts, illustrations and designs, and design source files.
Unless the outputs from a project are to be made publicly available under creative commons, or otherwise agreed between Crealo Pty Ltd and  the Client prior to the start of a project:

  • the ownership of copyrights of the material delivered to the Client (such as .pdf, .png, .jpg, mp4 files) are transferred to the Client upon payment of the final invoice.
  • design files and artworks (such as .ai, .psd, .indd files) remain the property of Crealo Pty Ltd after delivery.Should the Client wish to obtain design files, Crealo Pty Ltd will release files for a fee of 20% of the finished project.
  • Crealo Pty Ltd also retains the right to use and reproduce the Works for the purposes of display of the Works in portfolio and case studies, including for the purpose of soliciting new work from third parties.
